Drainage Easements

Council’s stormwater drainage network is often located within a drainage easement on private land. A drainage easement may be actual or implied. An actual easement is an area of land or part of a lot reserved by law and shown on title for the specific purpose of drainage services such as Council’s stormwater drainage. An implied easement is land not shown as an easement on Title but that contains a Council stormwater drain.

Can I build over an easement?
Council does not allow permanent or habitable structures to be built over an easement.
